Baggage

11.1 Baggage requirements
 

11.1.1 Baggage of the passenger shall be accepted for air transportation during its check-in at the airport of departure, transfer airport, airport of the stop or in any other point of baggage check-in, established by the air carrier.

11.1.2 Goods of a passenger depending on their size, weight and peculiarities can be carried as checked-in baggage or unchecked baggage (cabin baggage).

11.1.3 Weight of one place of the checked baggage shall not exceed 23 kg. Upon prior approval with the airline, the weight of one place of the checked baggage can be increased to 32 kg.

The total of three dimensions of a baggage piece (length, width, height) shall not exceed 158 cm.

Excess baggage, oversized baggage is accepted for air carriage only with the consent of the air carrier and if there is free capacity on board the aircraft for transportation, and also subject to payment by the passenger of the carriage of such baggage, unless the carriage of such baggage has already been agreed with the air carrier and paid.

A place of the baggage weighing more than 32 kg the passenger has to register for air transportation as cargo.

11.1.4 Information about the maximum amount and weight of baggage that the air carrier takes for transportation without payment is entered to the fare rules and specified in the contract of carriage provided to the passenger.

11.1.5 Information regarding payment for air transportation of excess baggage is provided by the air carrier, sales agent and/or handling agent during reservation of the air transportation or during passenger and baggage check-in.

11.1.6 Payment for air transportation of excess baggage is carried out in accordance with the established rules of the air carrier by fare that is valid on the day of issuing an order for different charges or a receipt for excess baggage and on the departure date indicated in the ticket. Such payment can be made in advance with the consent of the air carrier when issuing a ticket or at the airport during check-in.

In the event of failure to pay by the passenger of the corresponding tariffs and charges the air carrier has the right to refuse of air carriage of excess baggage.

11.1.7 If the passenger has registered baggage for air transportation, which is actually in a smaller amount than the one that the passenger preliminary paid, the air carrier is obliged to return to the passenger the difference between the amount of money paid and the cost of air transport of the actual amount of baggage.

In the event that a passenger has registered the baggage for air carriage, in fact, in bigger amount than that the one that the passenger has preliminary paid, the passenger must make an extra payment for the carriage of the actual amount of baggage.

11.1.8 In the event of an overload of the aircraft or in the absence of free tonnage, the air carrier, having informed the passenger about this, has the right to transport its baggage by the next flight or by the flight of another air carrier as soon as possible. The air carrier independently determines the baggage that will be transported by the next flight or the flight of the other air carrier.

11.1.9 The maximum weight and amount of baggage accepted for air carriage free of charge is determined by the fare rules and specified in the air carriage contract.

11.1.10 The air carrier is obliged to take measures for the conduct of air transportation of the passenger and its registered baggage on board the same aircraft, especially when according to the legislation in power it is demanded the presence of the passenger during customs procedure.When transporting checked baggage on board another aircraft, the air carrier is obliged, at the passenger’s choice, to deliver the baggage as soon as possible to the address provided by the passenger in the PIR - Property Irregularity Report or compensate transportation costs associated with delivering of such baggage in accordance with the requirements of the rules of the air carrier.

11.1.11 Baggage registration at the choice of the air carrier can be carried out in accordance with the baggage weight concept or baggage piece concept, that is, a combination of characteristics of weight, size, number of seats.

11.1.12 The air carrier is responsible for the safekeeping of the baggage from the time of its registration for air transportation and until it is issued to the passenger.

The acceptance of baggage by the air carrier for air transportation is confirmed by the teat-off coupon of the baggage identification tag that is issued to the passenger and baggage receipt regarding the number and weight of the places that are accepted for air carriage. From the moment the airline takes baggage for transportation and until it is issued, the passenger’s access to checked baggage is prohibited, except for cases of identification or additional care by the relevant authorized services.

11.2 Conditions of free baggage transportation
 

11.2.1 Regardless of the fare rules at which the ticket was purchased, the passenger has the right to transport such unchecked baggage (cabin baggage) free of charge, in particular: women’s and men’s bags, paper folder, outerwear, jacket, umbrella or walking stick, print media for reading during the flight, food for the child, necessary during the flight, flight baby cot (in the presence of a child under the age of 1 year), a stroller, a folded wheelchair and/or crutches.

The free baggage allowance norms (cabin baggage) with the exception of a wheelchair on airline flights are the following:
By weight:

  • the total weight should not exceed 7 kg.
By size (except for crutches or walking stick):
  • for Airbus 320/321 aircraft: the size of the seats should not exceed 55x40x20 cm;
  • for aircraft Embraer-145: the size of the seats should not exceed 55x35x15 cm.

A passenger is liable for cabin luggage during the whole transportation.

11.2.2 The air carrier has the right to expand the list and the total weight of items that are transported free of charge.

11.2.3 Regardless of the fare rules at which the ticket was purchased, the air carrier may charge an additional fee for transportation:

  • of things of passengers (regardless of their name), the size and weight of which does not meet the requirements of the air carrier rules;
  • of the things of the passengers which are not packed in accordance with the requirements of Chapter 5 of this section, regardless of their name and purpose;
  • of household and television, video, audio, photography equipment, the weight of one place of which is more than 10 kg;
  • of flowers, plant seedlings, food greenery, dried plants, trees and bushes with a total weight of more than 5 kg;
  • of correspondence, accompanied by the couriers;
  • of animals, with the exception of a guide dog that accompanies a passenger with a disability or reduced mobility.

11.2.4 The air carrier has the right to expand the list of items for the transportation of which additional charges may be charged, regardless of the fare rules.

11.3 Declared value of the baggage
 

11.3.1    A passenger shall have the right to declare the value of his/her check-in baggage.

11.3.2    The value of the checked-in baggage shall be declared separately for each piece of baggage. In case of the checked baggage value declaration the passenger shall pay a fare fixed by the air carrier.

11.3.3    For the confirmation of payment of the air baggage transportation with the declared value the air carrier or the sales agent shall issue the miscellaneous charges order or the excess baggage receipt where are stated the points between which is carried the transportation of the baggage with the declared value.

11.3.4    The conditions of acceptance to the air transportation of the baggage with declared value and the cost of such a service are established by the rules of the air carrier.

In case of loss or damage of the baggage with the declared value the amount of compensation is limited to its declared value.

11.4 Group baggage transportation
 

11.4.1 Upon the request of the passengers that are travelling in a group or the members of one family the air carrier is obliged to combine their baggage.

11.4.2 The union of the baggage places refers to the free baggage allowance. The baggage has to be registered separately for each passenger. The combination of the places of the baggage of the group of passengers or the members of one family refers only to the joint free baggage allowance for each passenger.

Group baggage by agreement of the passenger is registered at one person authorized by all the passengers, which is a member of the group of these passengers or family. Therewith in the transport documents of each of the passenger have to be stated the amount of places and weight of his/her baggage.

11.5 Requirements to baggage package
 

11.5.1 Passenger has to ensure proper package of every baggage place, which ensures its safekeeping during transportation and handling, and makes impossible to cause damage to passengers, cabin crew, third persons, aircraft, baggage of other passengers or other property, and also excludes the possibility of free or accidental access to baggage content by outside persons.  The air carrier is entitled to not accept the baggage for transportation as checked, the package of which does not correspond to the requirements of this clause or demand from the passenger to additionally pack the baggage.

The compliance of the baggage package with the requirements of this clause is determined by the air carrier.

11.5.2 Any baggage, which has outside damages that do not affect its integrity during air transportation and handling and cannot cause damage to passengers, cabin crew, third persons, aircraft, baggage of other passengers or other property, may be accepted as checked baggage with the airline’s consent.

Details about the presence and damage type of the baggage shall be indicated on a baggage receipt (Limited Release tag – transportation with limited liability) by the airline or its handling agent and may be confirmed also by the signature of the passenger.

11.6 Restrictions on the acceptance of the carriage of things as baggage
  11.6.1 Things that are not allowed to be included in the baggage:
  • goods, objects, liquid and other substances that may pose a significant risk to the health of passengers, flight safety or property of the air carrier or other passengers during transportation, in particular explosive, compressed gases, corrosive materials, oxidizers, radioactive materials, magnets, flammable materials, poisonous, harmful or irritating substances, as well as any other objects and substances specified in The Technical Instructions for the Sale Transport of Dangerous Goods by Air (Doc 9284) and Resolution of the Cabinet of Ministers of Ukraine dated May 12, 2007 No. 723 “On the introduction of a list of dangerous items and substances prohibited for carriage by air "as such, which are prohibited for carriage by passenger aircrafts.
11.6.2 Things that should not be included in checked baggage:
  • breakables and things that break or deteriorate quickly, money, keys, jewelry, electronic equipment, photo- and video equipment, products made of precious and semi-precious metals and stones, glasses, antiques, works of art, photographs, fur products, technical documentation, business documents, securities, valuables, medicines, medical records, identity documents;
  • goods, objects, medicine, the carriage of which is prohibited or restricted by the applicable laws of any country, from the territory of which, to the territory of which or through the territory of which the flight will be carried out;
  • goods that are not suitable for transportation by their nature, weight, size, shape or smell;
  • live animals, except as provided in Section 2 of part 12 of these Rules.

In the case of the attachment of these things in the checked baggage, the air carrier is not responsible for their safety.

11.6.3 Things that are recommended to be carried in hand baggage: breakables  and things that quickly break or deteriorate, electronic equipment (photo-, video equipment, computer equipment, storage media), software, money, keys, jewelry (precious and semi-precious metals and stones), glasses, antiques, works of art, photographs, fur products, technical documentation, business documents, securities, medicines in the required amount for the trip, medical documentation, passports and other identity documents, unique or irreplaceable items, other valuable items.

11.6.4 Things that can be accepted for carriage as checked baggage with the prior consent of the air carrier: firearms (including combat, hunting, sports weapons), pneumatic, gas weapons, pistols and revolvers designed to shoot rounds, which loaded with rubber bullets or bullets, which are similar in properties, edged weapons of all kinds and constructively similar products, ammunition and spare parts for weapons, as well as training, diluted, museum, souvenir, collection and fake weapons subject to the existence of corresponding permission to storage, carrying and transportation, gun and pistols for underwater hunting. Items and substances prohibited for transportation by passengers and crew members of civil aviation aircraft are determined by the aviation regulations of Ukraine.

11.6.5 The passenger has the right to include in the checked baggage and / or unchecked baggage his household items, alcoholic beverages, non-radioactive medical supplies and toilet and essential items, including containers with medical aerosols and other items and substances permitted for transportation in limited quantities in accordance with the Technical Instructions for Safe Transport of Dangerous Goods by Air (Doc 9284) or IATA Dangerous Goods Regulations, taking into account the differences established by the states and the air carrier and in the amount permitted by the relevant regulatory authorities.

11.7 The right to refuse to accept baggage for transportation
 

11.7.1 Checked baggage of a passenger who did not show up to boarding is subject to mandatory unloading from the aircraft.

11.7.2 The air carrier has the right to refuse to accept the baggage as checked in if it is not properly packed in suitcases with locks or other suitable containers to ensure safe transportation of the baggage and its handling using conventional means of cargo handling.

11.7.3 The air carrier has the right to refuse carriage or further carriage as baggage of items specified in clauses 1 - 3 of Section 6 of this part if it finds out on the basis of the relevant documents that such items contain any prohibited materials or objects.

The air carrier is not responsible for items that it refused to accept for carriage as baggage.

11.7.4 The air carrier may, at the passenger’s request, carry the items specified in clauses 1.2 of Section 6 of this part as unaccompanied baggage (cargo) subject to the requirements of Section 9 of this part.

11.8 Right for handling
 

11.8.1 In order to ensure flight safety and tracking the things specified in points 1 and 2 of Section 6 of this part, the air carrier has the right to require the passenger to undergo security checks carried out by the aviation security services of the air carrier, the airport, and provide baggage for handling, as well as to look after or organize looking after baggage in the absence of a passenger.

If a passenger refuses to provide baggage for looking after, the air carrier has the right to refuse to transport such passenger and/or baggage.

11.8.2 The air carrier shall not be liable for damage caused to the passenger or his baggage in the event of detection of items prohibited for air transportation during the implementation of care or other types of security control, except for cases of air carrier negligence.

11.8.3 The air carrier or handling agent shall perform the procedure for identifying the checked baggage of passengers who did not arrive on board the aircraft or left it before departure.

11.9 Unaccompanied baggage
 

11.9.1 At the request of the passenger and with the consent of the air carrier, baggage may be confirmed as unaccompanied baggage.

11.9.2 Unaccompanied baggage is accepted for air transportation between the same points between which the passenger travels, according to the ticket and only after the passenger has independently cleared the baggage.

11.9.3 Air carriage of unaccompanied baggage is confirmed by an air waybill, carried out according to the rules of air transportation of goods approved by the air carrier, and paid according to the tariffs for the carriage of goods established by the air carrier.

11.10 Cabin baggage
 

11.10.1 Things that have weight and dimensions established by the rules of the air carrier (clause 1, Section 2, part 11) are accepted for cabin baggage, that allows to safely place them in the cabin of the aircraft in the stowage bins or under the seat of the chair. It is prohibited to place cabin baggage and authorized things in the aisles of the aircraft cabin.

11.10.2 The rules for checked baggage apply for the things that do not meet the requirements of cabin baggage established by the air carrier or which are not allowed to be carried in the passenger cabin of the aircraft.

11.10.3 Cabin baggage should not contain any piercing and bladed objects, including nail scissors and nail files, medical injection needles, knitting needles, metal knives, corkscrews, objects, devices and toys that imitate all types of weapons, pistols or other weapons cigarette lighters, as well as items with blunt edges, which can cause bodily harm. It is also prohibited to bring any liquids, suspensions, creams, pastes with a capacity of more than 100 ml (grams) in one bottle (tube) on the aircraft board in hand baggage. The total amount of these substances in hand baggage packed in containers with a capacity of up to 100 ml (grams) should not exceed 1 liter (kg) per passenger. When using equipment for testing liquids, aerosols and gels, their volume for air transport is not limited.

Items and substances prohibited for transportation in the passenger cabin, but allowed for transportation in baggage, are determined by the Joint Aviation Requirements of Ukraine.

11.10.4 The passenger is responsible for the cabin baggage during the whole transportation.
